Supreme Court upholds acquittal, says police must not create evidence
The Supreme Court has upheld the acquittal of a woman in a double murder case, holding that an investigating officer's role is to collect evidence, not create it. A bench of Justice Manoj Misra and Justice Vijay Bishnoi found a taxi driver (PW-4) and a hotel employee (PW-18) were set up as witnesses, as the investigation never explained why, when and how their statements were recorded. The 2011 case involved the killing of a woman and her son in Diur, Himachal Pradesh. DNA mismatch and an incomplete chain of circumstances also weakened the prosecution. The State's appeal was dismissed.
